Alina Habba leaves her post in the wake of judicial disqualifies her service.
The ex-lawyer for the former president has resigned as the chief federal prosecutor in the state. This comes after a legal ruling that questioned her eligibility to serve.
Acceptance of Resignation
US Attorney General, Pam Bondi, confirmed her stepping down on the start of the week. Bondi stated that the appeals court finding made it "untenable" for the official to effectively run her office.
"Do not interpret compliance for surrender," she declared. "The effort will now stretch across the nation."
Court Ruling
Her resignation follows closely on a judicial panel determined that she had been unlawfully serving as the top prosecutor. This ruling is could influence scores of legal proceedings in the Garden State.
The court said that a interim role that skirted confirmation by the US Senate breached the statute on vacant positions.
Ongoing Legal Battle
The Attorney General added that Habba will stay on at the justice department as a senior adviser. Habba plans to seek further review of the disqualification, aiming for a different outcome.
In a statement, Bondi wrote that the judiciary "must not override the appointment of attorneys tasked with executing the fundamental role of the presidency of criminal prosecution."
Record and Legacy
The attorney general commended Habba's record and said that while she was in charge, the state capital of Newark saw a 20% reduction in criminal activity. Additionally that the Camden had its first summer in 50 years without a homicide.
Connection to Donald Trump
Habba, first joined Trump's personal legal team in 2021. Subsequently, she acted for her client in his business records case in 2024, leading to his conviction on multiple felony counts of falsifying business records.
Prior to assuming the top New Jersey post, Trump had revealed he was selecting her as his presidential counsellor in a potential future term, labeling the lawyer as deeply loyal and a dedicated fighter for justice.
